    Comparative Interreligious Jurisprudence: Feasibility, Opportunities, and Threats

    Abstract: 
    Different religions prescribe practical obligations for their adherents. The efforts of followers for a true understanding of religions have resulted in new studies and strategies. In Islam, knowledge of practical rulings and religious duties is termed “fiqh” (jurisprudence). This paper explores whether a comparative framework—"interreligious comparative jurisprudence"—can analyze Islamic and other religious legal systems and what the opportunities and threats of adopting such an approach to studying religious teachings are. Using analytical-inferential methods and library research, it concludes that such a framework is not only feasible through the argumentative jurisprudential comparison of rulings and practical teachings of religions, but also offers opportunities to promote Islamic principles globally, foster interfaith dialogue, and influence international law and global Muslim activities. However, there are risks and challenges that proponents must navigate to maximize benefits and mitigate harms.

    Abstract: 
    ادیان گوناگون مجموعه‌هایی از تکالیف عملی را برای پیروان خود عرضه کرده‌اند که تلاش دین‌داران برای شناخت صحیح آنها سبب پدید آمدن سازوکارها و دانش‌هایی خاص شده است. دانش شناخت احکام عملی و تکالیف دینی در اسلام، «فقه» نامیده می‌شود. اکنون با تسامح در کاربست اصطلاح «فقه» برای دانش نظیر در دیگر ادیان، باید دید که آیا می‌توان میان فقه اسلام و ادیان دیگر مقایسة موازنه‌ای نمود و اتخاذ چنین رویکردی در مطالعة تعالیم ادیان چه فرصت‌ها و تهدیدهایی دارد؟ مقالة پیش رو پس از بررسی علمی لازم، با روش تحلیلی ـ استنباطی و با مطالعة کتابخانه‌ای نتیجه می‌گیرد که نه‌تنها چنین کاری در قالب «فقه مقارن بین‌الادیان» و از راه موازنة استدلالی احکام بر اساس مطالعة مقایسه‌ای تعالیم عملی ادیان با رویکرد فقهی امکان‌پذیر است، بلکه ورود به این عرصه می‌تواند فرصت‌های قابل توجهی را برای توسعه و ترویج گفتمان حق اسلام در سطح جهانی ایجاد کند و در عرصه‌هایی همچون تقریب ادیان، حقوق بین‌الملل و فعالیت‌های جهانی مسلمانان نتایج و فواید قابل توجهی در پی داشته باشد. با این وجود، تهدیدهای مهمی نیز در ورود به این عرصه وجود دارد که توجه به آنها از مهم‌ترین وظایف فعالان این حوزه برای پیشگیری از آفت‌ها و آسیب‌های آن است.
