A comparative study of the provisions of Jewish and Islamic law in capital crimes shows that Westerns’ doubt about religious rights is mainly rooted in the unjustifiable provisions of the Torah, such as the execution of animals, juveniles, and the repeated execution of non-Jews. However, these rulings which clearly violate certain legal principles are not approved by Islamic law. The Western thinkers' doubt and skepticism about Jewish rights cannot be extended to Islam. On the other hand, the poor performance of Islam-based systems is often the result of thematic laws that have nothing to do with Islamic jurisprudence. به طور کلی اتهامات وارده بر حقوق اسلامی در خصوص جرایم موجب اعدام، در دو مسئله ریشه دارد: نخست شباهت نظام کیفری یهودی و اسلامی در سیاست های جنایی، تعریف جرایم مستوجب اعدام و حتی کیفیت اعدام ها، که موجب تسری ویژگی های حقوق یهودی از جمله خشونت طلبی آن به حقوق اسلامی شده است؛ دوم اجرای اعدام در نظام های مبتنی بر حقوق اسلامی. با بررسی تطبیقی احکام شریعت یهود و اسلام در جرایم مستوجب اعدام، مشخص می شود که علت اصلی بدبینی غرب به حقوق دینی، ریشه در احکام توجیه ناپذیر تورات، نظیر اعدام حیوانات، نوجوانان ناخلف و اعدام مکرر غیریهودیان دارد. این در حالی است که این احکامِ ناقض اصول مسلم حقوقی، مورد تأیید حقوق اسلامی نیست. بنابراین بدبینی اندیشمندان غربی به حقوق یهودی، قابل تسری به اسلام نیست. از سوی دیگر، عملکرد ضعیف نظام های مبتنی بر اسلام نیز غالباً ناشی از قوانین موضوعه ای است که ارتباطی با فقه اسلامی ندارند. https://marefateadyan.nashriyat.ir/sites/marefateadyan.nashriyat.ir/files/article-files/2_36.pdf
