This paper, employing a descriptive-analytical method with direct reference to Qur'anic verses and Torah passages, as well as the writings of Islamic scholars and Jewish thinkers, seeks to analyze the commonalities and differences between the Qur'an and the Torah in the domain of rulings and law (Sharia). The Qur'an, in addition to explicitly stating some rulings, has also articulated non-explicit rulings, as well as legal principles and jurisprudential rules (al-qawa'id al-fiqhiyyah). However, the Torah has only dealt with the explicit and detailed expression of religious rulings. The primary difference between these two sacred scriptures, as examined in this paper, lies in the domain of jurisprudential rules. The findings of this research indicate that the root of this difference in expression is that the Noble Qur'an is universal and eternal, whereas the Torah is Israelite and limited. The requirement of a universal and eternal scripture is that it should mention the generalities of rulings and the principles of derivation (uṣūl al-istinbāṭ), with the details to be discussed elsewhere. The consequence of this difference manifests in the dynamism of jurisprudence (fiqh) and in the enumeration of the number of passages containing rulings and law in the sacred scripture.}, keywords = {Qur'an, Torah, verses of rulings, Halakhic Passages of the Torah, principles of jurisprudence, }, title_fa = {بررسی تحلیلی تفاوت شیوه بیان احکام در قرآن و تورات ریشه‌ها و پیامدها}, abstract_fa ={قرآن و تورات، کتب آسمانی اسلام و یهودیت به احکام و شریعت اهمیت ویژه داده و بدان پراخته¬اند. این نوشتار با روش توصیفی – تحلیلی با مراجعة مستقیم به آیات قرآنی و فقرات توراتی و همچنین کتب علمای اسلامی و دانشمندان یهودی در صدد تحلیل اشتراکات و افتراقات بیان قرآن و تورات در حوزه احکام و شریعت است. قرآن علاوه بر بیان صریح برخی از احکام، احکام غیرصریح، اصول و قواعد فقهی را نیز بیان کرده است اما تورات صرفاً به بیان صریح و تفصیلی احکام شرعی پرداخته است. عمدة تفاوت این دو کتاب مقدس در این نوشتار، بحث قواعد فقهی می¬باشد. یافته¬های این پژوهش نشان می¬دهد که ریشه این تفاوت بیان در این است که قرآن کریم، جهانی و جاودانه است ولی تورات، بنی-اسرائیلی و محدود است. اقتضای کتاب جهانی و جاودانه این است که کلیات احکام و قواعد استنباط گفته شود و تفصیل آن در جایی دیگر ذکر شود. پیامد این اختلاف، در پویایی فقه و در شمارش تعداد فقرات احکامی و شریعتی کتاب آسمانی بروز می¬کند. }, keywords_fa = {قرآن ,تورات ,آیات¬الاحکام ,فقرات شریعتی تورات ,اصول فقه ,قواعد فقهی ,}, url = {https://marefateadyan.nashriyat.ir/node/5003990}, eprint = {} }
